Texas Penal Code § 22.01 defines assault as:
- Intentionally, knowingly, or recklessly causing bodily injury to another;
- Threatening another with imminent bodily injury; or
- Causing physical contact with another when the offender knows or has reason to believe that the other will regard said contact as offensive or provocative.
What Is Assault in Texas?
Assault could be threatening to attack/injure someone, physically hitting them, throwing an object at their person, and a number of other actions. There is also aggravated assault, which is assault involving serious bodily injury and/or the exhibition of a deadly weapon during the commission of the assault.
What Can You Be Charged With?
Simple assault can be charged as a Class B or Class A misdemeanor, or as a third-degree felony depending on the degree of injury and whether or not the offense was against an officer, firefighter, paramedic, or other public servant. Aggravated assault is a second- or first-degree felony.
Class B misdemeanors incur a fine of up to $2,000, a jail sentence of up to a year, or both. First-degree felonies incur a prison sentence of 5 years to life, as well as a fine of up to $10,000.
